This website, homebackupsupply.com, is operated by Home Backup Supply, a store operated by Brightmark ("we", "us", "our"). By visiting the site or buying from us, you agree to these Terms of Service. If you do not agree, please do not use the site.

2. Eligibility

You must be at least 18 years old, or the age of majority where you live, to place an order.

3. Products, pricing and availability

We try to describe products, specifications and prices accurately, but errors can occur. Product specifications and warranty terms are set by each manufacturer. All products are subject to availability, and prices may change without notice. We may refuse or cancel any order, including for product unavailability, pricing or listing errors, or suspected fraud. If we cancel an order after payment was taken, we refund it in full.

4. Payment

Payments are processed through Shopify's secure checkout. You agree to provide current, complete and accurate purchase and account information.

5. Installation and safe use

We do not install equipment, and installation is not included in any price. Whole-house standby generators and hard-wired home battery systems must be installed by a licensed electrician, and by a licensed plumber where a gas line is involved, following local code and any required permits, which are the buyer's responsibility. Follow the manufacturer's instructions; fuel-burning generators must only be run outdoors, away from windows, doors and vents.

6. Warranty

Products are covered only by their manufacturer's warranty, which varies by brand and model. Except as required by law, the website and our services are provided "as is" and "as available", without warranties of any kind from us.

7. Limitation of liability

To the fullest extent permitted by law, Home Backup Supply and Brightmark are not liable for any indirect, incidental, special or consequential damages arising from your use of the site or any product, and our total liability for any claim will not exceed the amount you paid for the product involved.

8. Intellectual property

Content on this site, including text, graphics and logos, belongs to us or our suppliers and may not be copied or reused without permission. Brand names and product images belong to their respective owners.

9. Prohibited uses

You may not use the site for any unlawful purpose, interfere with its operation, or attempt to access accounts or systems without authorization.

The site may link to or use third-party services, such as payment processors and carriers. Their own terms and policies apply, and we are not responsible for their content.
